Welcome to Mud & Maple! The terms "we", "us" and "our" refer to Mud & Maple. Mud & Maple operates this website and online store, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). Mud & Maple is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms"), describe your rights and responsibilities when you use the Services.

SECTION 1 – ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you confirm that you are at least 18 years of age. If you permit a minor to use the Services on a device you own or manage, you accept responsibility for their use.

To use the Services, including browsing our store or purchasing products, you may be asked to provide certain information such as your email address, billing, payment and delivery details. You confirm that all information you provide is correct, current and complete, and that you have the right to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity under your account. You may not transfer, sell, assign or license your account to any other person.

SECTION 2 – OUR PRODUCTS

All Mud & Maple products are made to order and crafted specifically for you. We have made every effort to provide an accurate representation of our products in our online store. However, please note that colours and product appearance may differ slightly from how they appear on your screen due to variations in device displays and settings.

We do not warrant that the appearance of any product will be identical to that depicted in our online store.

All product descriptions are subject to change at any time without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit the quantities of any products that we offer.

SECTION 3 – ORDERS

When you place an order, you are making an offer to purchase. Mud & Maple reserves the right to accept or decline your order at its discretion. Your order is not accepted until we confirm acceptance and have received and processed your payment.

Because our products are made to order, please review your order carefully before submitting. Once your order has been accepted and production has begun, we are unable to accommodate cancellation requests. If you need to cancel an order before production has started, please contact us as soon as possible at admin@mudandmaple.co. We will do our best to accommodate your request but cannot guarantee cancellation once an order has been placed.

In the event that we do not accept, amend or cancel an order, we will attempt to notify you using the contact details provided at the time the order was placed.

Your purchases are subject to our Returns and Refunds Policy [LINK].

You confirm that your purchases are for personal or household use and not for commercial resale.

SECTION 4 – RETURNS AND REFUNDS

All Mud & Maple products are made to order, crafted specifically for you. Because of this, we are unable to accept returns or offer refunds on any orders once production has begun.

Please inspect your order as soon as it arrives. If your item is defective, damaged or not what you ordered, contact us immediately at admin@mudandmaple.co so we can assess the issue and arrange a replacement or refund where appropriate. Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015.

If you need to cancel your order before production has started, please get in touch as soon as possible at admin@mudandmaple.co. Once your item is in production, we are unable to accept cancellations.

SECTION 5 – PRICES AND BILLING

Prices, discounts and promotions are subject to change without notice. The price charged for a product will be the price in effect at the time the order is placed, as confirmed in your order confirmation email. Unless otherwise stated, posted prices include VAT where applicable but do not include delivery charges.

We may offer promotions from time to time that are governed by separate terms. If there is a conflict between the terms of a promotion and these Terms, the promotion terms will apply.

You agree to provide current, complete and accurate purchase and payment information for all purchases. You agree to promptly update your account and payment details so that we can complete your transactions and contact you as needed.

You confirm that any payment information you provide is true, correct and complete, and that you are authorised to use the relevant payment method.

SECTION 6 – DELIVERY

All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by delivery carriers, customs processing or events outside our control. Once we transfer products to the carrier, risk of loss passes to you.

Our Services, including but not limited to all trademarks, branding, text, displays, images, graphics, video and audio, and the design, selection and arrangement thereof, are owned by Mud & Maple, its affiliates or licensors, and are protected by applicable intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any material from the Services without our prior written consent.

Mud & Maple's names, logos, product and service names, designs and slogans are trademarks of Mud & Maple or its affiliates or licensors. You must not use such trademarks without the prior written permission of Mud & Maple.

SECTION 8 – OPTIONAL TOOLS AND THIRD-PARTY LINKS

You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor control. Such tools are provided "as is" and "as available" without any warranties or endorsement. We shall have no liability arising from your use of optional third-party tools.

Mud & Maple is powered by Shopify, which enables us to provide the Services to you. Any sales and purchases you make in our store are made directly with Mud & Maple. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Mud & Maple. You hereby release Shopify and its affiliates from all claims, damages and liabilities arising from or related to your purchases and transactions with Mud & Maple.

EXCEPT AS EXPRESSLY STATED BY MUD & MAPLE, AND TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE AND NON-INFRINGEMENT. NOTHING IN THESE TERMS EXCLUDES OR LIMITS YOUR STATUTORY RIGHTS UNDER THE CONSUMER RIGHTS ACT 2015.

SECTION 16 – LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, MUD & MAPLE, ITS PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, LOST PROFITS, LOST REVENUE, LOSS OF DATA, REPLACEMENT COSTS OR ANY SIMILAR DAMAGES, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS OUR LIABILITY FOR: (A) DEATH OR PERSONAL INJURY CAUSED BY OUR NEGLIGENCE; (B) FRAUD OR FRAUDULENT MISREPRESENTATION; OR (C) ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW, INCLUDING UNDER THE CONSUMER RIGHTS ACT 2015.

You agree to indemnify, defend and hold harmless Mud & Maple, Shopify, and our affiliates, partners, officers, directors, employees, agents and service providers from any losses, damages, liabilities or claims, including reasonable legal costs, arising out of: (1) your breach of these Terms; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.

SECTION 18 – SEVERABILITY

If any provision of these Terms is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any remaining provisions.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

These Terms and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of England and Wales. You and Mud & Maple agree to submit to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.
